This is a simple story.
It is Nancy who should make an effort to argue TOM down, and
Tom doesn't have to make an effort for Nancy's argument.
According to a legal parlance,
"Burden of proof" is generated by the side that needs the profit.

In plain words, it means,
"If you want to enforce your policy to others, you should make an effort to realize it."
as a self-evident truth.
